A zoning decision does not approve a data center

This ordinance changes the zoning of one property. It doesn’t authorize building or operating any specific development. Any future proposal needs its own application and public review. See how development review works.

What the ordinance does

The ordinance changes the zoning of the West Campus, western quarter property from “A” Agriculture to “I-3” Industrial (Heavy) District and updates the City of Enid Zoning Map to match. Section I gives the property’s legal description.

It also includes the standard closing sections. These repeal any conflicting ordinances, keep pending cases and existing rights intact, and let the rest of the ordinance stand if any part is found invalid.

The five-year review

If the planned development hasn’t substantially started within five years of the ordinance taking effect, City staff must bring the property’s zoning back to the City Commission. The Commission then considers whether to begin returning the property to “A” Agriculture.

Only physical construction counts as a start. Engineering, surveying, planning, permits and site investigations don’t. The zoning doesn’t change on its own when the five years end, and any later change needs public notice and a hearing.

This ordinance hereby amends the City of Enid Zoning Map accordingly.

Section III: Zoning Classification Reconsideration

If, within five years (5) years following the effective date of this Ordinance, the development contemplated by the rezoning has not substantially commenced, City staff shall submit the zoning classification of the affected property to the City Commission for review and consideration of whether proceedings should be initiated to restore the property’s former “A” Agriculture classification, together with any corresponding amendments to the City’s Comprehensive Plan.

For purposes of this Section, substantial commencement shall mean the initiation of material, physical construction activities directly associated with the authorized development and shall not include preliminary engineering, surveying, planning, permitting, site investigations, or other activities undertaken solely in preparation for construction.

The expiration of the five (5)-year period shall not automatically terminate or otherwise change the property’s zoning classification. Any subsequent rezoning, amendment of the Comprehensive Plan, or amendment extending the development period established by this Section shall be undertaken in accordance with all applicable notice, public hearing, and ordinance adoption requirements.

Section IV: Repealer

All ordinances or parts thereof, which are inconsistent with this ordinance, are hereby repealed.

Section V: Savings Clause

Nothing in this ordinance hereby adopted shall be construed to affect any suit or proceedings now pending in any court, or any rights acquired or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any rights or remedy of any character be lost, impaired or affected by this ordinance.

Section VI: Severability

If any one or more of the sections, sentences, clauses or parts of this ordinance, chapter or section shall, for any reason, be held invalid, the invalidity of such section, clause or part shall not affect or prejudice in any way the applicability and validity of any other provision of this ordinance. It is hereby declared to be the intention of the City Commission of the City of Enid that this section of the Enid Municipal Code would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part not been included.
