Sec. 32-37. Same--Notice,etc.

-3. Same-Notice, etc. The city code office will notify in writing the owners of trees specified in section 32-2. Removal shall be done by said owners at their own expense within sixty (60) days after the date of service of notice. In the event of failure of owners to comply with such provisions, the city shall have the authority to remove such trees and charge the cost of removal to said owners.

Sec. 32-4. Distance from curb and sidewalk.

Street trees may not be planted closer than four (4) feet from any street curb without approval from the city engineer, nor shall any trees be planted closer than eight (8) feet from the street curb of major arterials without approval of the city engineer. For the purpose of this section, the edge of the paved portion of a street shall be defined as the street curb.

Sec. 32-5. Distance from street corners and fireplugs.

No street tree shall be allowed to create a sight distance restriction, as defined in the cit traffic control policies, of uncontrolled intersections within the city. All fireplugs within the city shall be free from any and all obstructions which render them inaccessible to fire protection equipment and personnel.

Sec. 32-6. Public tree care.

(a) The city shall have the right to plant, prune, maintain and remove trees, plants and shrubs within the lines of all streets, alleys, avenues, lanes, squares or public grounds as may be necessary to insure public safety or to preserve or enhance the symmetry and beauty of such public grounds.

(b) The city may remove or cause or order to be removed, any tree or part thereof which is in an unsafe condition or which by reason of its nature is injurious to sewers, electric power lines, gas lines, water lines, or other public improvements, or is affected with any injurious fungus, insect or other pest The city shall have the right to cause the removal of any dead or diseased trees on private property within the city, when such trees constitute a hazard to life and property, or harbor insects or disease which constitute a potential threat to other trees within the city.
